Selection of an AI Preparation Mode is made solely by the User unless otherwise expressly indicated by the Services. 1. MassApply may provide features including, without limitation: • natural-language job-search tools; • job discovery and ranking; • job-import tools; • resume parsing and storage; • resume tailoring; • multiple AI preparation modes; • ATS-oriented analysis; • keyword analysis; • fit or alignment estimates; • gap analysis; • resume strategy generation; • resume editing; • AI-assisted natural-language editing; • cover-letter generation; • screening-answer generation; • resume templates; • PDF previews and exports; • application review tools; • application tracking; • browser-extension functionality; and • other related features that we may add, modify, suspend, or remove. MassApply is software assistance. It is not an employer, recruiter, staffing agency, employment agency, headhunter, attorney, career counselor, educational institution, credentialing body, applicant tracking system operated by an employer, or representative of any employer. MassApply does not make hiring decisions. MassApply does not determine whether you are qualified for a position. MassApply does not guarantee that an employer will consider, review, receive, rank, accept, respond to, or act on an application. 2. MassApply Is an Assistive Tool, Not a Recommendation to Submit MassApply may generate, modify, reorganize, suggest, score, summarize, or present information that could be used in connection with a job application. The fact that the Services generate or display content does not mean that MassApply recommends, endorses, certifies, approves, or advises you to submit that content. AI-generated material is a draft for your independent review. You alone decide: • whether to use an AI-generated statement; • whether to modify it; • whether it accurately reflects you; • whether it is appropriate for a particular employer; • whether to submit an application; • which version to submit; • which employer to apply to; • what information to disclose; and • whether an employment opportunity is appropriate for you. Your decision to use or submit material generated, modified, suggested, scored, or presented by MassApply is your independent decision. 2.1. No Agency or Fiduciary Relationship No Agency Relationship Your use of the Services does not create any: • employment relationship; • agency relationship; • recruiter relationship; • staffing relationship; • brokerage relationship; • fiduciary relationship; • attorney-client relationship; • consultant relationship; • partnership; • joint venture; or • representative relationship between you and MassApply. MassApply is software. MassApply is not your employer. MassApply is not acting on behalf of any employer. MassApply is not authorized to negotiate employment, accept offers, make representations, certify qualifications, or bind you in any way. 3. Human Review Is Required MassApply is designed around human review. You agree that you will review application materials before submitting them to any employer, recruiter, job platform, applicant tracking system, governmental entity, or other third party. You are responsible for independently checking: • names; • addresses; • contact details; • employers; • dates; • job titles; • degrees; • schools; • licenses; • certifications; • security clearances; • work authorization; • professional credentials; • skills; • technologies; • achievements; • metrics; • dollar amounts; • percentages; • team sizes; • management responsibilities; • project descriptions; • employment status; • salary information; • geographic information; • statements about customers or employers; • statements regarding confidential work; • statements regarding protected or proprietary information; and • every other factual assertion appearing in material you may submit. You agree not to submit AI-generated material without first determining that it accurately represents you and is appropriate for its intended use. If you submit or otherwise use an application document after reviewing or having had a reasonable opportunity to review it, you are deemed to have approved the content you chose to use. No Duty to Correct MassApply has no obligation to identify inaccuracies, inconsistencies, exaggerations, omissions, legal issues, employer policy violations, licensing requirements, immigration issues, security clearance requirements, export-control restrictions, or any other defect in User Content or AI-generated content. The absence of a warning, suggestion, correction, or validation from MassApply shall not be interpreted as approval, verification, certification, or confirmation that any statement is accurate, lawful, truthful, or appropriate for submission. Independent Decision-Making You acknowledge that every decision to: • upload information; • edit information; • regenerate AI output; • select an AI Preparation Mode; • export a document; • download a PDF; • copy generated content; • paste generated content; • submit an application; • answer screening questions; • communicate with an employer; or • otherwise use the Services is made solely by you using your own independent judgment. MassApply does not direct, instruct, require, or recommend that any specific Generated Content be submitted to any employer or third party. 4. AI-Generated Content May Be Wrong The Services rely in part on artificial-intelligence systems, including large language models and related automated technologies. Artificial intelligence is probabilistic and may produce incorrect, incomplete, misleading, inconsistent, outdated, fabricated, overly confident, or otherwise unsuitable outputs. AI may, among other things: • misinterpret a job posting; • misinterpret your experience; • infer a skill you do not possess; • exaggerate responsibility; • suggest language that overstates experience; • alter nuance; • omit relevant facts; • create inaccurate metrics; • confuse employers or dates; • misstate qualifications; • use awkward or generic language; • produce content that sounds artificial; • misunderstand industry terminology; • incorrectly classify a skill as supported or unsupported; • incorrectly estimate ATS compatibility; • incorrectly estimate fit; • incorrectly estimate recruiter preferences; • generate repetitive language; • generate language inappropriate for a particular employer; • include statements that violate an employer's application rules; or • fail in ways we have not anticipated. MassApply may employ multiple AI stages, checks, agents, models, prompts, rules, or validation processes intended to improve quality. Those safeguards do not eliminate the possibility of error. No internal check, confidence indicator, score, validation step, "truth" process, AI reviewer, recruiter-style review, or other feature should be interpreted as a certification of accuracy. By submitting, exporting, downloading, copying, printing, uploading, sharing, emailing, or otherwise using any AI-generated application material after having a reasonable opportunity to review it, you represent and warrant that you have independently evaluated the material, determined that it truthfully and accurately reflects your qualifications, experience, and intentions, and voluntarily accept sole responsibility for its use in any employment, recruiting, licensing, credentialing, or hiring process. 5. You Are Responsible for Your Career Representations You are solely responsible for ensuring that information you provide to employers is truthful, complete where required, and not misleading. You must not knowingly use MassApply to falsely claim: • employment you did not perform; • education you did not complete; • professional licenses you do not hold; • certifications you did not earn; • skills you do not possess; • security clearances you do not hold; • work authorization you do not possess; • clients you did not serve; • accomplishments you did not achieve; • metrics you cannot reasonably support; • managerial authority you did not have; • awards you did not receive; • compensation you did not earn; • publications you did not author; • projects you did not perform; or • other material qualifications that are false or materially misleading. Certain AI modes may produce more aggressive transformations than others. The presence of such a feature does not authorize deception. The User remains responsible for deciding whether any generated language is truthful. 6. Multiple AI Modes MassApply may provide different AI preparation modes, currently or in the future, that use different optimization goals, prompts, processing stages, or levels of rewriting. Different modes may produce materially different results from the same resume and job description. MassApply offers different modes so you can choose the level of rewriting appropriate for each application. One mode may emphasize preservation of original language. Another may emphasize ATS-oriented terminology. Another may emphasize broader restructuring or positioning. A difference between outputs does not mean that one is factually correct. You must independently review every mode you use. No mode is represented as appropriate for every application. You acknowledge that: • different modes may generate different results; • no mode is guaranteed to produce superior results; • MassApply does not recommend one mode over another for every user or every application; and • selecting an AI mode remains solely your decision. 7. Aggressive or Maximum-Alignment Features Some MassApply features may substantially restructure, reframe, or rewrite application materials in an effort to increase apparent alignment with a job description. Such output may create a greater risk of: • overstatement; • implication beyond available evidence; • ambiguity; • inaccurate inference; • or language that an employer might consider misleading. If you use an aggressive or maximum-alignment mode, you accept heightened responsibility for reviewing every resulting statement. MassApply does not authorize you to submit false qualifications. MassApply does not certify that maximum-alignment output is suitable for real-world submission. 8. Fit Scores, Match Scores, ATS Scores, Rankings, and Recommendations MassApply may provide numerical scores, categories, rankings, recommendations, labels, or assessments regarding: • job fit; • skill match; • keyword coverage; • ATS compatibility; • resume quality; • recruiter readability; • job alignment; • missing skills; • transferable skills; • application strength; • or similar concepts. These outputs are estimates only. They are not scientific measurements. They are not employer decisions. They do not reflect access to an employer's proprietary ATS configuration, recruiter criteria, scoring methodology, hiring committee, internal candidate pool, referral status, interview process, or business needs unless explicitly stated. A score of 90% does not mean you have a 90% probability of receiving an interview. A "Strong Fit" label does not establish that you are legally or professionally qualified. A low score does not mean you should not apply. Employers may evaluate candidates differently. 9. ATS-Related Features MassApply may attempt to improve compatibility with applicant tracking systems ("ATS"), recruiter searches, job-description terminology, resume parsers, or other hiring technologies. ATS technology varies significantly among employers and vendors. MassApply does not know or control the specific configuration used by any employer. MassApply does not guarantee: • successful ATS parsing; • keyword recognition; • ranking; • scoring; • candidate visibility; • recruiter search placement; • passage through a screening process; • an interview; • an offer; • or any other hiring result. References to "ATS optimization," "ATS-friendly," "ATS compatibility," "ATS match," "getting past ATS," or similar terminology describe an optimization objective, not a guaranteed outcome. Applicant Tracking Systems ("ATS") differ significantly between employers. Many ATS systems contain proprietary ranking algorithms, semantic matching systems, recruiter workflows, knockout questions, custom scoring models, employer-specific filters, recruiter preferences, AI screening systems, manual review processes, and other technologies that are not publicly known. MassApply has no access to those proprietary systems. MassApply cannot determine how a particular employer configures its ATS. Employers may modify their hiring systems at any time without notice. Accordingly, references to: • ATS optimization; • ATS compatibility; • ATS scores; • ATS readiness; • ATS-friendly formatting; • ATS keyword optimization; • ATS matching; or • similar terminology describe only the optimization goals of MassApply's software. They do not constitute guarantees of: • ATS parsing; • recruiter visibility; • keyword recognition; • ranking; • interview selection; • hiring decisions; • or any other employment outcome. No Guarantee of Human Review MassApply cannot guarantee that any application will be reviewed by a human recruiter. Employers may use automated systems to reject, rank, filter, or otherwise process applications before human review occurs. MassApply cannot control those systems. 10. Job Discovery and Recommendations MassApply may search, aggregate, ingest, import, rank, summarize, recommend, or display employment opportunities from third-party job boards, public sources, company career pages, ATS platforms, APIs, or other services. Job information may be: • incomplete; • outdated; • duplicated; • altered; • incorrectly parsed; • geographically inaccurate; • mislabeled; • expired; • fraudulent; • unavailable; • or already filled. MassApply does not independently verify every employer or job posting. MassApply does not verify that: • compensation is accurate, • jobs remain open, • employers are legitimate, • recruiters are authorized, • locations are correct, • benefits exist, • or visa sponsorship is actually offered. You are responsible for investigating employers and opportunities before providing sensitive information, paying money, traveling, resigning from employment, relocating, or taking other action. MassApply is not responsible for employment scams or fraudulent third-party job postings except to the extent liability cannot legally be excluded. 11. Natural-Language Job Search Natural-language job-search features interpret your written preferences through automated systems. Those systems may misunderstand or infer: • job titles; • industries; • salary expectations; • locations; • remote preferences; • seniority; • exclusions; • credentials; • employment types; • or other criteria. You should review any interpretation presented by the Services. MassApply does not guarantee that returned jobs satisfy every preference. 12. No Employment Guarantee MassApply does not guarantee: • interviews; • callbacks; • recruiter responses; • employment offers; • salary levels; • employment duration; • career advancement; • improved hiring probability; • reduced rejection rates; • or any particular return on your subscription. Testimonials, examples, demonstrations, marketing materials, hypothetical results, match-score improvements, ATS-score improvements, or success stories are not guarantees that you will experience similar results. Your results depend on factors outside MassApply's control. 13. No Professional Advice The Services are not legal, financial, tax, immigration, credentialing, licensing, psychological, educational, or other regulated professional advice. Career-related suggestions are informational software outputs and not individualized professional advice. For professional questions, consult an appropriately qualified professional. 14. Screening Questions MassApply may generate suggested responses to job-application questions. You are solely responsible for reviewing them. This is particularly important for questions involving: • criminal history; • security clearances; • work authorization; • sponsorship; • disabilities; • veteran status; • protected characteristics; • professional licenses; • salary; • willingness to relocate; • conflicts of interest; • background investigations; • drug testing; • certifications; • government contracting; • export controls; • citizenship; • legal attestations; and • statements made under penalty of perjury. MassApply does not make legal determinations concerning those matters. You should personally answer any question requiring an attestation or certification. 15. Application Submission Unless a feature expressly states otherwise, MassApply does not independently submit applications on your behalf. When the Services open a third-party job posting, prepare a downloadable file, pre-fill information, provide form answers, or otherwise facilitate application activity, you remain responsible for the final submission. If future functionality allows application submission or automated form completion, any such functionality will operate only subject to applicable feature-specific terms and user authorization. MassApply has no authority to accept employment, negotiate compensation, enter contracts, make legal representations, or bind you to an employer. 16. Browser Extensions and Third-Party Sites MassApply may interact with third-party websites or ATS systems through browser-extension functionality or related integrations. Third-party sites can change without notice. An integration may: • stop working; • fill the wrong field; • fail to upload a document; • be blocked; • trigger bot-detection; • violate a third party's technical expectations; • or behave unexpectedly. You must verify all information entered into a third-party site before submission. You are also responsible for complying with applicable third-party terms. 17. Your Account You must provide accurate account information. You are responsible for maintaining the confidentiality of your credentials. You are responsible for activity that occurs through your account unless caused by MassApply's failure to use legally required security measures. Notify us promptly if you believe your account has been compromised. We may restrict, suspend, or terminate accounts for: • abuse; • fraud; • unauthorized access; • scraping; • excessive automated usage; • security threats; • chargebacks or payment abuse; • violation of these Terms; • unlawful activity; • interference with the Services; or • other legitimate operational or safety reasons. 18. Eligibility You must be legally capable of entering into a binding agreement. You must be at least 18 years old to create an account or purchase Paid Services. 19. Acceptable Use You may not use the Services to: • violate applicable law; • impersonate another person; • create fraudulent job applications; • knowingly falsify qualifications; • harass employers; • spam; • scrape or harvest data at unauthorized scale; • bypass technical safeguards; • circumvent package or rate limits; • access another user's account; • reverse engineer the Services except where law expressly permits; • probe security systems without authorization; • upload malware; • interfere with service availability; • generate unlawful discriminatory content; • infringe intellectual-property rights; • disclose another person's confidential personal data without authority; • submit trade secrets that you are not authorized to disclose; • automate access beyond permitted functionality; • resell consumer accounts; • use MassApply to create a competing dataset or model where prohibited by law; or • use the Services in a way that materially harms MassApply, other users, employers, or third parties. 20. Confidential and Employer Information Do not upload employer trade secrets, classified information, export-controlled technical information, health data, government-restricted information, customer data, or other confidential material unless you are legally authorized to do so. If your existing resume contains confidential information, you are responsible for removing it before upload. 21. User Content "User Content" includes materials you submit to the Services, including resumes, career history, job descriptions, preferences, profile information, messages, prompts, edits, cover letters, screening responses, files, and feedback. As between you and MassApply, you retain your rights in your User Content. You grant MassApply a limited, worldwide, non-exclusive license to host, reproduce, transmit, process, transform, display, and otherwise use User Content only as reasonably necessary to provide, maintain, secure, troubleshoot, improve, and support the Services; comply with law; and enforce these Terms, subject to the Privacy Policy. 21.1. No Duty to Monitor or Verify User Content MassApply provides software tools that process User Content at your direction. MassApply has no obligation to monitor, inspect, verify, fact-check, review, edit, or approve: • resumes; • cover letters; • screening-question responses; • prompts; • natural-language instructions; • uploaded files; • edits; • AI-generated content; • job descriptions; • employer information; • application materials; • communications; or • any other User Content. MassApply may, but is not required to, investigate suspected violations of these Terms, remove content, suspend accounts, or take other action in its sole discretion. The failure to review or remove any content does not constitute approval, endorsement, certification, or verification of that content. 22. AI Inputs and Third-Party AI Providers Certain User Content may be transmitted to third-party AI service providers in order to generate or analyze content. MassApply currently may use providers such as OpenAI through commercial/API services. OpenAI currently states that data submitted through its API is not used for model training by default unless the API customer opts in, although certain API data may be retained for service provision and abuse monitoring subject to the provider's current policies. AI vendors and their policies may change. See our Privacy Policy for material categories of processors and data-sharing practices. 22.1 AI Detection MassApply does not represent or guarantee that any AI-generated material: • will appear human-written; • will avoid AI detection; • will avoid plagiarism detection; • will avoid employer review tools; • will avoid automated screening systems; • will avoid recruiter scrutiny; or • will satisfy any employer policy regarding AI-assisted application materials. Employers may use technologies or policies that identify, discourage, prohibit, or otherwise evaluate AI-assisted application materials. You alone are responsible for determining whether use of AI-generated content complies with an employer's policies and expectations. 22.2 Employer Policies You are solely responsible for complying with every employer's: • application instructions; • honesty requirements; • disclosure requirements; • AI-use policies; • confidentiality obligations; • export-control requirements; • licensing requirements; • eligibility requirements; • government contracting rules; • security requirements; • and all other application conditions. MassApply does not determine whether AI-assisted materials are permitted by a particular employer. Employer AI Policies Some employers prohibit, restrict, or require disclosure of AI-assisted application materials. MassApply does not determine whether AI-assisted content complies with any employer's policies. Users are solely responsible for reviewing and complying with any such requirements before submitting application materials. 22.3 No Reliance You acknowledge that you are not relying upon any: • marketing statement; • website representation; • demonstration; • example; • sample resume; • sample cover letter; • AI-generated output; • ATS score; • fit score; • recruiter score; • quality score; • keyword score; • testimonial; • projection; • estimate; • success story; or • similar representation as a guarantee of any particular employment outcome. You acknowledge that your decision to purchase or use the Services is based upon your own independent judgment. 22.4 Data Preservation MassApply is not a permanent storage service. Although reasonable efforts may be made to preserve User Content, you remain responsible for maintaining your own copies of: • resumes; • tailored resumes; • cover letters; • generated PDFs; • application history; • screening answers; • prompts; • exported files; • and other materials. MassApply has no obligation to preserve deleted content except where required by applicable law. 22.5 Force Majeure MassApply shall not be liable for delays, interruptions, failures, or inability to perform caused by events beyond its reasonable control, including: • internet failures; • cloud provider outages; • OpenAI outages; • Stripe outages; • Supabase outages; • DNS failures; • cyberattacks; • denial-of-service attacks; • ransomware; • power failures; • natural disasters; • fire; • flood; • earthquake; • pandemic; • epidemic; • labor disputes; • governmental action; • export restrictions; • acts of war; • terrorism; • civil unrest; • or failures of third-party infrastructure. 23. Feedback If you voluntarily provide ideas, product suggestions, bug reports, feature requests, or other feedback, you grant MassApply the right to use that feedback without payment or obligation to you. This does not transfer ownership of your resume or other User Content. 24. Intellectual Property The Services, excluding User Content, are owned by MassApply and its licensors. This includes, as applicable: • software; • user interfaces; • product architecture; • prompts; • workflows; • branding; • logos; • text; • graphics; • templates; • scoring systems; • databases; • documentation; • compilation; • and other proprietary materials. No rights are granted except the limited right to use the Services under these Terms. 25. Paid Services and Subscription Billing MassApply may offer Free, Job Seeker, Unlimited, or other plans. The specific price, billing period, package allowance, and included features presented to you at checkout control for your purchase. Paid subscriptions recur automatically until canceled unless otherwise stated. You authorize MassApply's payment processor to charge the payment method you provide for recurring fees, applicable taxes, and authorized charges. MassApply currently uses Stripe to process payments. MassApply reserves the right to modify, replace, discontinue, or redefine subscription plans, usage allowances, Application Package allocations, pricing, and Fair Use thresholds for future billing periods upon reasonable notice. Such changes will not apply retroactively to billing periods that have already been paid. MassApply generally does not receive your complete payment-card number. Stripe processes payment information under its own privacy practices. Stripe states that it may process transaction details, identifiers, device information, fraud signals, and payment information in connection with payments. Paid subscriptions are subject to the following usage restrictions: no account sharing; no resale; no API farming; no automated bulk generation beyond intended use; fair-use throttling may apply; "Unlimited" refers to ordinary individual job-search usage, not unlimited compute resources. One Application Package is consumed each time a user initiates a supported AI application-preparation pipeline, regardless of the number of intermediate AI steps, prompts, or internal processing stages performed by MassApply. 25.1 Fair Use and Acceptable Subscription Use Your subscription is intended solely for your own personal job search and career development activities. Paid subscriptions, including plans described as "Unlimited," are intended for reasonable and ordinary individual use. The term "Unlimited" refers to access for normal individual job-seeking activities and does not grant unlimited computing resources, unrestricted AI processing, enterprise-scale usage, unrestricted infrastructure capacity, unlimited concurrent requests, or unrestricted access to MassApply's systems. Interpretation of "Unlimited" For purposes of any subscription plan described as "Unlimited," MassApply retains the sole and reasonable discretion to determine whether a User's activity constitutes ordinary individual job-search use or exceeds the intended scope of the applicable subscription. Determinations regarding fair use, excessive usage, abnormal consumption of computing resources, automated activity, commercial usage, account sharing, abuse, or misuse shall be made by MassApply in good faith based upon the totality of the circumstances, available technical information, system performance, and other relevant factors. No User acquires any contractual right to unlimited computing resources, unlimited AI processing, unlimited infrastructure capacity, unlimited requests, unlimited throughput, or any guaranteed level of system resources merely because a subscription is marketed or described as "Unlimited." The term "Unlimited" refers only to ordinary individual use of the Services consistent with these Terms and remains expressly subject to this Fair Use Policy. To protect the stability, security, availability, integrity, and performance of the Services for all users, MassApply may monitor usage patterns and implement reasonable technical safeguards, including but not limited to: • request throttling; • temporary rate limiting; • queue prioritization; • concurrency limits; • temporary feature restrictions; • temporary suspensions; • additional verification requirements; or • other reasonable technical or administrative measures designed to maintain platform reliability, prevent abuse, or protect other users. Without limiting the foregoing, you agree that you will not: • share your account or subscription with any other individual or entity; • permit multiple individuals to access a single account; • resell, sublicense, lease, assign, transfer, distribute, or commercially exploit the Services; • use the Services to provide resume-writing, recruiting, staffing, consulting, or similar services to third parties without our prior written permission; • incorporate the Services into another software product, API, automation platform, commercial offering, or managed service; • perform automated bulk generation of resumes, cover letters, screening answers, or other AI-generated materials beyond ordinary individual job-search use; • use bots, scripts, crawlers, scraping tools, or other automated systems to access the Services except as expressly authorized by MassApply; • attempt to circumvent subscription limits, fair-use protections, rate limits, concurrency limits, or other technical safeguards; • create multiple accounts or otherwise manipulate usage limits for the purpose of avoiding subscription restrictions; or • use the Services in any manner that, in MassApply's reasonable judgment, places an excessive or unreasonable burden on our systems, materially degrades the experience of other users, or otherwise interferes with the operation, security, or reliability of the Services. MassApply reserves the right, in its sole and reasonable discretion, to investigate suspected abuse and to temporarily or permanently throttle, rate limit, restrict, suspend, or terminate access to the Services where reasonably necessary to protect the platform, enforce these Terms, prevent fraud or abuse, comply with legal obligations, maintain service reliability, or safeguard the experience of other users. Users acknowledge that reasonable differences of opinion regarding usage levels or fair-use determinations shall not, by themselves, establish that MassApply acted improperly or in breach of these Terms. MassApply's good-faith determination regarding enforcement of this Fair Use Policy shall be final except where otherwise required by applicable law. Enforcement of this Fair Use Policy, including any throttling, rate limiting, temporary restriction, suspension, or termination implemented in accordance with these Terms, shall not constitute a breach of this Agreement and shall not entitle a User to any refund, credit, damages, reimbursement, or other compensation except where expressly required by applicable law. Interpretation Headings are provided solely for convenience and shall not affect interpretation of these Terms. The words "including," "includes," and "such as" shall be interpreted as meaning "including without limitation." 26. Application Packages and Usage Limits MassApply may limit AI pipeline usage by "application packages," pipeline executions, fair-use rules, rate limits, or other disclosed metrics. Unused monthly package allowances: Unused monthly Application Packages expire at the end of each billing period and do not roll over unless expressly stated otherwise. For an Unlimited plan, "Unlimited" means no ordinary fixed monthly package quota for normal individual use, subject to: • fair use; • fraud prevention; • abuse controls; • technical capacity; • reasonable rate limits; • account security; • automated-use restrictions; • and these Terms. Unlimited access does not authorize automated resale, credential sharing, scraping, denial-of-service behavior, or unreasonable machine-generated consumption inconsistent with normal individual job-search use. 27. Free Services MassApply may offer a limited number of free pipeline executions or guest previews. Free allowances may reset periodically. Free features may be changed or discontinued. Creating multiple accounts to evade free limits is prohibited. 28. Automatic Renewal If you subscribe to a monthly recurring plan, your subscription will automatically renew for additional monthly periods until canceled. At checkout, we display the subscription amount, billing interval, recurring nature of the charge, and how to cancel. Renewal occurs automatically for successive billing periods of the same duration unless canceled before the next renewal date. Cancellation prevents future renewals but does not retroactively cancel charges already incurred for the current billing period. 29. Cancellation You may cancel through the available billing-management interface or other cancellation method we provide. Unless otherwise stated at checkout, cancellation takes effect at the end of your current paid billing period. You retain applicable paid access through that period unless: • your payment is reversed; • fraud occurs; • your account is terminated for material misuse; • or applicable law requires another result. 30. Refunds Except where required by law or expressly stated otherwise: • subscription fees are non-refundable; • partial billing periods are not prorated; • unused application packages have no cash value; • and cancellation does not entitle you to a refund for the unused portion of a current billing period. Nothing in this section eliminates refund rights that cannot legally be waived. 31. Pricing Changes We may change prices prospectively. Existing subscribers will receive notice where required by applicable law or payment-platform rules. Continued subscription after an effective pricing change constitutes acceptance where legally permitted. 32. Taxes Prices may exclude applicable sales, use, VAT, GST, or other taxes unless stated otherwise. You are responsible for applicable taxes associated with purchases except taxes imposed on MassApply's income. 33. Third-Party Services The Services depend on third parties, which may include: • Stripe; • Supabase; • OpenAI; • hosting providers; • email providers; • job-board APIs; • ATS platforms; • search providers; • analytics providers; • error-monitoring providers; • cloud providers; • and other vendors. MassApply does not control those services. Third-party outages, API changes, discontinued access, rate limits, or security events may affect functionality. 34. Service Availability MassApply may experience downtime. We do not guarantee continuous or error-free access. Features may be modified, suspended, replaced, or discontinued. We may implement maintenance, security patches, rate limits, queueing, or capacity controls. 35. Beta and Experimental Features Features labeled beta, preview, experimental, early access, or similar may be less reliable. You use them at your own risk. We may change or remove them without notice to the extent permitted by law. 36. Security MassApply uses measures intended to protect User Content and accounts. No internet-connected system is perfectly secure. You acknowledge risks including unauthorized access, credential compromise, vendor compromise, software defects, network interception, and other security incidents. Nothing in these Terms waives any security obligation imposed on MassApply by applicable law. 37. Privacy Our Privacy Policy governs our processing of personal data. If these Terms conflict with the Privacy Policy regarding personal-data practices, the Privacy Policy controls to the extent applicable. Unless expressly stated otherwise, MassApply does not use your resumes or application materials to train third-party foundation AI models for unrelated customers. 38. No Sale of Personal Data MassApply does not sell personal information for money. MassApply also does not intend to sell personal information as that term is defined under applicable U.S. state privacy laws. 39. This does not mean that every resume may automatically be used to train foundation models. 40. Copyright and Infringement Users must have the right to upload content they submit. DMCA notices should be sent to: MassApply DMCA Agent Email: massapplysupport@gmail.com If MassApply receives a valid copyright complaint, we may remove or disable access to the allegedly infringing material while investigating the claim. Where appropriate, Users may have the opportunity to submit a counter-notification as permitted by applicable copyright law. Nothing in this section obligates MassApply to independently monitor User Content for potential copyright infringement, nor does it create any duty to proactively investigate uploaded materials. MassApply reserves the right to determine, in its reasonable discretion, the appropriate response to any alleged infringement, consistent with applicable law. MassApply is a software platform that processes User Content at the direction of its Users. Except as expressly required by applicable law, MassApply does not claim ownership of User Content, does not verify ownership of uploaded materials, and is not responsible for determining whether a User possesses the legal rights necessary to upload or use particular content. AI Assists; You Decide MassApply uses artificial intelligence to assist users with job discovery, resume analysis, resume preparation, cover letters, screening answers, application organization, and related tasks. AI does not replace your judgment. You decide what information to use and what to submit. 2. How AI Is Used Depending on the feature, MassApply may use AI to: • parse resumes; • analyze job descriptions; • identify keywords; • estimate candidate-job alignment; • identify skill gaps; • identify transferable experience; • create a resume strategy; • rewrite resume sections; • draft cover letters; • draft screening responses; • interpret natural-language job preferences; • rank jobs for the user; • provide editing suggestions; • perform quality-control passes. 3. Multiple AI Processes MassApply may use multiple models, AI agents, prompts, algorithms, or processing stages. Different stages may analyze different aspects of the same application. Multiple stages are intended to improve quality but do not guarantee accuracy. 4. AI Modes Different modes are intended for different use cases. They may vary in: • degree of rewriting; • keyword emphasis; • preservation of original phrasing; • restructuring; • narrative strategy; • risk of unsupported implication. You are responsible for selecting the mode you consider appropriate. 5. AI Limitations AI may hallucinate. AI may misinterpret context. AI does not know facts you have not provided. AI cannot independently verify your employment history. AI cannot know an employer's internal hiring model. AI cannot reliably predict interview probability. MassApply may utilize multiple AI systems, prompts, processing stages, models, validation layers, reviewer agents, quality-control agents, truth-checking systems, recruiter simulations, ATS-oriented analyses, or other automated techniques designed to improve output quality. These processes improve—but cannot guarantee—the quality, factual accuracy, completeness, legality, appropriateness, or effectiveness of any generated material. No internal validation process should be interpreted as certification that output is correct. MassApply never submits applications on your behalf without your explicit authorization. 6. Human Review MassApply's intended workflow is: Generate → Review → Edit → Approve → Apply Users should never treat AI output as automatically true. 7. No Automated Hiring Decision MassApply is designed for candidates. It does not make an employer's hiring decision. MassApply's candidate-facing fit scores or job rankings are intended to help the user organize their job search and are not employer evaluations. 8. Responsible Use Do not use AI to knowingly fabricate qualifications. Do not use MassApply to impersonate another candidate. Do not submit language that you know is false. 9. Third-Party AI MassApply may transmit relevant information to commercial AI API providers. For example, OpenAI states that API inputs and outputs are not used for model training by default unless the business customer opts in. 10. Continuous Improvement AI behavior may change as: • prompts change; • models change; • job markets change; • vendors update; • MassApply improves pipelines. Outputs may therefore differ over time. 11. Report a Problem You may report the following to massapplysupport@gmail.com: • hallucinations; • unsafe content; • privacy concerns; • incorrect application information; • inappropriate job recommendations; • security issues. MassApply has no control over changes made by third-party AI providers. 13. Third-Party AI Providers MassApply relies upon independent third-party providers including artificial intelligence providers. MassApply is not responsible for: • AI model outages; • API failures; • degraded model quality; • hallucinations; • latency; • provider policy changes; • discontinued models; • provider pricing changes; • rate limits; • provider security incidents; or • other failures occurring within third-party systems. 14. AI Scores Are Informational Only MassApply may provide: • ATS scores • Fit scores • Confidence scores • Readability scores • Keyword scores • Recruiter-readiness scores • Missing-skill estimates • Quality indicators • Recommendations These are informational estimates generated by automated systems.
